By creating an account or using Surbee, you agree to these Terms of Service, our Privacy Policy, and any additional terms that may apply. If you do not agree to these terms, you may not use our services.
2. Description of Service
Surbee provides an AI-powered platform for:
• Creating surveys using natural language and AI assistance
• Distributing surveys and collecting responses
• Analyzing survey data with AI-powered insights
• Detecting and filtering fraudulent responses
• Managing survey projects and collaborating with team members
3. Account Registration
To use Surbee, you must:
• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
You may not share your account credentials or allow others to access your account.
4. Subscription Plans and Payments
Surbee offers various subscription plans with different features and credit allocations. By subscribing to a paid plan:
• You authorize us to charge your payment method on a recurring basis
• Subscription fees are non-refundable except as stated in our Refund Policy
• Credits reset monthly and do not roll over to the next billing period
• We may change pricing with 30 days notice
5. Acceptable Use
You agree not to use Surbee to:
• Create surveys that are unlawful, harmful, threatening, or discriminatory
• Collect sensitive personal data without proper consent
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Attempt to circumvent security measures or access unauthorized data
• Use automated means to abuse the platform or generate fraudulent responses
• Harass, spam, or harm other users
6. User Content
You retain ownership of the surveys and content you create on Surbee. By using our service, you grant us a license to:
• Process your content through AI services to provide features
• Store and display your surveys to respondents
• Analyze aggregated, anonymized data to improve our services
You are responsible for ensuring you have the right to collect any data through your surveys.
7. Intellectual Property
The Surbee platform, including its software, design, features, and branding, is owned by Surbee and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without permission.
8. AI-Generated Content
Surbee uses artificial intelligence to help generate survey questions and analyze responses. While we strive for accuracy:
• AI-generated content may contain errors or biases
• You are responsible for reviewing and approving all survey content
• We do not guarantee specific results from AI analysis
9. Fraud Detection
Our Cipher fraud detection system analyzes survey responses to identify potentially fraudulent submissions. While we aim for accuracy, we cannot guarantee detection of all fraudulent responses or that legitimate responses will never be flagged. You are responsible for final decisions regarding response validity.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may:
• Perform maintenance that temporarily affects access
• Modify or discontinue features with reasonable notice
• Experience outages due to factors beyond our control
11. Limitation of Liability
To the maximum extent permitted by law, Surbee shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Disclaimer of Warranties
Surbee is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, secure, or meet your specific requirements.
13. Termination
We may suspend or terminate your account if you violate these terms or engage in prohibited activities. You may cancel your account at any time through your account settings. Upon termination:
• Your access to the platform will be revoked
• Your data may be deleted according to our data retention policy
• No refunds will be provided for partial billing periods
14. Indemnification
You agree to indemnify and hold Surbee harmless from any claims, damages, or expenses arising from your use of the platform, your survey content, or your violation of these terms.
15. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes at least 30 days before they take effect. Continued use of Surbee after changes become effective constitutes acceptance of the new terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Surbee operates, without regard to conflict of law principles.
